Welcome to GyanTV, a platform owned and operated by Behtar Technology Private Limited (“Company”, “we”, “us”, or “our”) with office address at 1501, 19th Main Rd., Sector 1, HSR Layout, Bangalore, Karnataka - 560102. These Terms and Conditions (“Terms”) govern your access to and use of the GyanTV App, Website, and related Services.
By accessing, downloading, or using the GyanTV App or Website, you (“User”, “you”, or “your”) agree to be bound by these Terms, along with our Privacy Policy which form an integral part of this agreement. If you do not agree to these Terms, please do not use or access our Services.
We may update, modify, or revise these Terms from time to time. Any material changes to these Terms shall be communicated through the App, Website, or via email notification. Your continued use of the Services following such changes shall constitute your acknowledgment and acceptance of the revised Terms.
Further, the Platform may, from time to time, introduce additional features, services, promotional campaigns, or other offerings, each of which may be governed by separate terms and conditions (“Supplementary Terms”). Such Supplementary Terms shall be made available through appropriate hyperlinks or other accessible means on the Platform. By participating in, accessing, or using such features, services, or campaigns, You expressly agree to be bound by the applicable Supplementary Terms in addition to these Terms.
About GyanTV
GyanTV is an educational and entertainment platform that allows Users to access the Services and Content available on the platform for learning and educational purposes. The Services encompasses all features of GyanTV including but not limited to its products, software and services offered through the App. GyanTV is not endorsed, affiliated or sponsored by any statutory organisation, institution or third party/ individual.
By starting a transaction to use any of these Services, you agree that you are entering into a legally binding agreement with us for the provision of those Services.
Definitions
“App” refers to the mobile application operated by GyanTV that enables Users to access the Content and Services on the platform.
“Company”, “we”, “us”, “our” refers to GyanTV [Behtar Technology Private Limited], including its mobile application, website, software systems, affiliates, employees, and representatives that collectively provide and operate the Services under the brand name “GyanTV”.
“Content” may include but is not limited to all graphics, images, audio, video, software, data and any other material available on or through the App or Website provided by GyanTV or its partners.
“User”, “You”, “Your” refers to any individual who accesses, downloads, registers, or uses the GyanTV mobile application (“App”).
“Service” means streaming, searching, downloading (if permitted), or accessing any feature of GyanTV.
Eligibility / Service Restrictions
Use of GyanTV and Website (“Platform”) is permitted only by individuals who are at least 18 years of age. Minors of 13 years of age and above may only use the Services with the parental or guardian consent to access and/or use the Service.. By accessing or using the Platform, you represent and warrant that you are legally capable of entering into binding contracts. In the event you have not attained such age, you may access and/or use the Service only upon obtaining valid consent from your parent or legal guardian to enter into and be bound by these Terms of Use. If you are not legally competent to enter into these Terms of Use and/or have not obtained the requisite parental or guardian consent, you shall not access, use, or avail the Service, in whole or in part.
Each User must create and use their own individual account. Accounts are personal and non-transferable. You are not permitted to create, operate, or access an account on behalf of another individual or entity, nor allow any other person to use your account. You are solely responsible for all activities that occur under your account and for maintaining the confidentiality of your login credentials. The Company shall not be liable for any loss or damage arising from unauthorized use of your account or failure to maintain its security.
Gyan TV services and any Content accessed through the Services are for Your persona and non-commercial use only, wherein during the subscription period GyanTV grants You a limited, non-exclusive, non-transferable right to access the Services and Content. Except for the foregoing, no right, title or interest shall be transferred to you. You agree not to use the service for public performances.
GyanTV reserves the right to suspend or terminate your access to the Platform if it is discovered that you have provided false information regarding your age, identity, or eligibility, or are otherwise using the Platform in violation of applicable laws or these Terms.
The Platform is intended for access and use within India. Users accessing the Platform from other jurisdictions do so at their own discretion and are responsible for compliance with local laws, if and to the extent applicable.
User Account and Registration
Account Creation: To access features or Services offered on the GyanTV Platform, you may be required to create a User account by providing accurate and complete information as prompted including your mobile number. You agree to update such information as and when required to keep it true, current, and complete.
Account Credentials and Security: You are solely responsible for maintaining the confidentiality and security of your login credentials, including your username and password. Your are expected not to share the one-time password with anyone during the time of the login on the Platform. Any activity carried out through your account shall be deemed to have been undertaken by you, and the Company shall not be liable for any loss or damage arising from unauthorized access or misuse of your account.
Multiple Accounts: You may not create more than one account for yourself, or create an account for anyone else without proper authorization. The Company reserves the right to merge, suspend, or terminate duplicate or fraudulent accounts at its sole discretion.
Account Verification: GyanTV reserves the right to verify your identity and eligibility at any time, including by requesting additional documentation or information, to ensure compliance with these Terms or applicable laws.
Subscription Terms & Billing
Subscription: GyanTV offers the subscription-based model for the purposes of availing the Services on the platform. The payment for the subscription for availing the Services is within the app. By choosing to make an In-App Purchase, you acknowledge and agree that additional terms specific to the purchase, disclosed to you at the time of transaction may apply and are hereby incorporated into these Terms & Conditions. The validity of the subscription shall be thirty (30) days from the date of activation of the subscription model upon the payment of the amount as displayed on the GyanTV.
Billing Cycle: Upon the registration of the User on the Platform, the User will be charged the subscription fee upon the completion of the trial period for the use of the Services and Content on the Platform, any other charges You may incur in connection with Your use of the Services, such as taxes and possible transaction fees, will be charged to the Payment Method for the specific transaction. The period of the billing cycle will depend on the type of subscription plan that the User chooses when the User registered for the Services and transaction is successful.
Payment Method: For the use of the Services of the Platform, We provide one or more Payment Methods. You authorise us to charge any Payment Method associated to Your account in case Your Primary Payment is declined or no longer available to us for payment of your subscription fees. If a payment fails for example, because it expires, lacks sufficient funds, or for any other reason and You do not cancel your subscription, We may suspend Your access to the service until a valid payment method is successfully charged. However, You still liable for any unpaid charges.
Updating your Payment Method: You may update your Payment Methods and We may update Your Payment Method using information provided by the payment service providers. Following the updating of the Payment Method, You authorise us to continue to charge the applicable subscription via Payment Method(s).
Changes to the Price and Subscription Plans: We may change Our subscription plans and the price of Our Service from time to time. We will notify You at least one month before any price changes or changes to your subscription plan will become effective.
User Obligations
By accessing or using the GyanTV, Website, or any related Services, you agree to comply with all applicable laws, our Platform Policies, and these Terms. You also agree to use the App responsibly, respectfully and in a manner that does not harm other users or the integrity of the platform.
Use the GyanTV lawfully and respectfully: You agree to-
Not violate any applicable laws or regulations (whether in India or elsewhere).
Not attempt to circumvent security or technical protections, interfere with or overload our systems, or engage in activities such as introducing malicious code, scraping data, spamming, or attempting unauthorized access.
Not use automated tools, bots, or scripts that may misuse or disrupt the Services of GyanTV.
Not interfere with or disrupt the experience of other users.
Not infringe upon the intellectual property rights of GyanTV or any third party.
Provide Accurate Information: You must provide up-to-date information when registering or using Our Services, including Your correct mobile number. You must not impersonate any person or provide false or misleading information while using GyanTV.
Keep Your Account Secure: You are solely responsible for maintaining the confidentiality of your account, including your login credentials, phone number, one-time passwords and payment details.
Do not share your account or credentials with anyone. Each account is intended for individual use and is linked to a single mobile number.
GyanTV is not responsible for any loss or damage resulting from your failure to safeguard your account information.
Respect Intellectual Property: All content, trademarks, and materials owned or provided by GyanTV remain the property of GyanTV or its licensors. Unauthorized use may lead to account termination or other action as per our Platform Policies.
Content and Intellectual Property Right
Ownership of the Platform and Content: All rights, title, Content and interest in and to the GyanTV App, Website, and all materials, features, software, design elements, text, graphics, logos, icons, interfaces, and any other content made available by GyanTV (collectively, “GyanTV Content”) are owned by or licensed to Behtar Technology Private Limited (“GyanTV”). Except as expressly stated in these Terms, no part of the GyanTV or its Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, sold, licensed, or otherwise used without our prior written consent.
Limited License to Users: We grant You a limited, non-exclusive, non-transferable, revocable license to access and use the GyanTV and Services solely for your personal, non-commercial use and in accordance with these Terms. This license does not confer any ownership rights and may be revoked by us at any time if you violate our Terms of Use.
Intellectual Property Complaints: We respect intellectual property rights and expect our users to do the same. If you believe that any content on the GyanTV infringes your intellectual property rights, please contact us at support@gyantv.in with relevant details, and we will take appropriate action as per applicable laws.
Prohibited Conduct and Content Restrictions
General Conduct: While using the GyanTV or Services, you agree not to engage in any activity that:
Violates any applicable law or regulation, whether in India or elsewhere.
Harms, abuses, harasses, threatens, impersonates, or intimidates others.
Interferes with or disrupts the proper functioning, security, or integrity of the GyanTV, including by introducing malware, attempting unauthorised access, scraping data, or overloading systems.
Uses any automated tools, bots, scripts, or similar technologies to collect data or interact with the App.
Attempts to bypass any security or authentication measures implemented by GyanTV.
No Commercial Use Without Consent: You agree not to use the GyanTV or its Services for any commercial purpose, including but not limited to promoting products, soliciting users, or conducting advertising, unless expressly authorised in writing by GyanTV.
No Data Mining or Reverse Engineering: You must not attempt to decompile, reverse engineer, disassemble, or derive source code from any part of the GyanTV or its systems, nor may you attempt to obtain unauthorised access to our databases, code, or networks.
Third-Party Links and Tools
The GyanTV App and Website may contain links to third-party websites, applications, or services, and may integrate features such as AI tools, analytics services, social media sharing options, or payment gateways (“Third-Party Services”). These are operated and maintained by independent entities not controlled by GyanTV.
We do not endorse, monitor, or assume responsibility for the content, accuracy, availability, privacy practices, or policies of any Third-Party Services. Your use of such links or tools is at your own discretion and risk, and shall be governed by the respective terms, conditions, and privacy policies of those third parties.
Third-Party Tools and Integrations: Certain functionalities within the App may rely on third-party APIs, plug-ins, or integrations (for example, payment processors, AI-based features, or communication tools). These third parties may collect or process information as part of their services. By using such features, you acknowledge and consent to any data handling practices performed by those providers under their respective terms.
Cookies and Tracking Technologies: The GyanTV and Website may use cookies, web beacons, local storage, and similar tracking technologies to enhance your experience, analyse usage, and personalise content or recommendations. You may modify your device or browser settings to disable cookies; however, some features of the App may not function properly if cookies are disabled. No Liability for Third Parties: GyanTV shall not be responsible or liable, directly or indirectly, for any damage, loss, or harm arising from or related to your interaction with, reliance upon, or use of any Third-Party Services, tools, or content made available through the GyanTV or Website.
Account Deletion
Voluntary Account Deletion: You may delete your GyanTV account at any time through the App settings or by writing to support@gyantv.in. Once your account is deleted, your access to the App and Services will be permanently disabled.
Data Retention after Deletion: Upon account deletion, we may retain certain user information for a limited period as required by law, to comply with legal obligations, resolve disputes, enforce our rights, or prevent misuse. Disclaimers and Limitation Of Liability
The GyanTV, Website and Services are provided on an “As-Is” and “As Available” basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, GyanTV, its affiliates, officers, employees, and partners disclaim all representations and warranties, including but not limited to:
Merchantability, fitness for a particular purpose, and non-infringement;
Availability, reliability, accuracy, or completeness of the Services or Content; and
Freedom from viruses or other harmful components.
When using the Service, you may encounter Content from various sources. GyanTV does not guarantee the accuracy, usefulness, safety, or intellectual property rights of this Content. You acknowledge that some Content may be inaccurate and non-useful, whereas GyanTV does not guarantee any results whatsoever. By using the Service, you waive any legal or equitable rights or remedies you may have against GyanTV in relation to such Content.
You are solely responsible for your use of the GyanTV and for any actions or decisions taken based on information obtained through it.
To the fullest extent permitted by applicable law, GyanTV, its affiliates, directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with:
Your access to or use of (or inability to access or use) the App, Website, or Services;
Any content, communication, or interaction with other users or third parties;
Any unauthorised access, use, or alteration of your data;
Any reliance placed on advice, content, or materials available through the App.
Maximum aggregate liability: In no event shall GyanTV’s total liability to You, for all claims combined, exceed the amount paid by you (if any) for using the services and the payment of the subscription fees immediately preceding the event giving rise to the claim.
Legal Disclosures and Liability: GyanTV may disclose user information to law enforcement or other authorities when required to do so by law or when reasonably necessary to:
Respond to a valid legal request.
Protect the rights, property, or safety of GyanTV, its users, or the public.
Prevent fraud, misuse, or security breaches.
Indemnity
You agree to indemnify, defend, and hold harmless Behtar technology Private Limited (“GyanTV”), its affiliates, directors, officers, employees, licensors, and agents from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to:
Use or misuse of the GyanTV, Website, or Services.
Your breach or violation of these Terms and Conditions, Privacy Policy, or Community Guidelines.
Your infringement or alleged infringement of any third-party rights, including intellectual property or privacy rights.
Any interaction, transaction, or dispute between you and third party.
Your Responsibility: You acknowledge that you are solely responsible for:
Maintaining the confidentiality and security of your account credentials.
Ensuring that your use of the GyanTV complies with all applicable laws and regulations; and
The consequences of any actions, decisions or communications made through your account.
GyanTV’s Right to Assume Defence: GyanTV reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you. In such an event, you agree to fully cooperate with GyanTV in asserting any available defences and in providing necessary assistance to resolve the claim.
Continuing Obligation: Your obligations under this Section shall survive the deletion of your account and the discontinuation of your use of the Services.
Governing Laws & Dispute Resolution
These Terms shall be governed by the laws of India. If any dispute, controversy, or claim arises out of or relates to these Terms and Conditions, or your use of the GyanTV website or app, both parties agree to first attempt to resolve the matter amicably through mutual discussion. If the dispute cannot be resolved through discussion within 30 (Thirty) days, it shall be referred to and finally resolved by binding arbitration under Sole Arbitrator appointed mutually. The arbitration shall be conducted in accordance with the Indian Arbitration and Conciliation Act, 1996. The arbitration proceedings shall take place in Bangalore, Karnataka, India and the proceeding shall be conducted in English. The decision of the arbitrator(s) shall be final and binding on all parties, and may be entered as a judgment in any court of competent jurisdiction.
Changes to the Terms
We may update the Platform Policies from time to time, including to reflect changes in the services we offer or to improve how GyanTV operates. This may include modifying, disabling, or removing certain features or Services and Content, either temporarily or permanently, at our discretion.
Where any change is material or affects your rights or obligations, we will take reasonable steps to notify you, for example, by updating this page or showing an in-app notification.
If any change requires your consent under applicable law, we will obtain it before implementing the change.
By continuing to use GyanTV after updated platform policies take effect, you agree to be bound by them. We encourage you to review this page periodically to stay informed about any updates.
